Hanoi, Vietnam – The Ministry of Culture, Sports and Tourism issued Circular No. 08/2023/TT-BVHTTDL on 2 June 2023 (the “Circular”) stipulating templates in copyright and related rights registration activities.

Accordingly, the Circular stipulates the forms of Declarations for registration of copyright, the forms of Declarations for registration of related rights, the forms of Certificates for registration of copyright and the forms of Certificates for registration of related rights. The Circular applies to agencies, organizations and individuals participating in the registration of copyright and related rights.

Under the Circular, the following forms have been promulgated:

Appendix 1 – Copyright Registration Forms; Application Forms for Registration of Related Rights:

a) Form No. 01: Declaration of copyright registration for literary works; science; lectures, speeches and other speeches; data collection; journalistic works; literary, folk art and other works expressed in the form of writing or other characters;

b) Form No. 02: Declaration of copyright registration for applied art works;

c) Form No. 03: Declaration of copyright registration for computer programs;

d) Form No. 04: Declaration of copyright registration for musical works;

e) Form No. 05: Declaration of copyright registration for fine art works or photographic works;

f) Form No. 06: Declaration of copyright registration for cinematographic works or theatrical works;

g) Form No. 07: Declaration of copyright registration for textbooks and textbooks;

h) Form No. 08: Declaration of copyright registration for architectural works, maps, diagrams, maps, drawings related to topography, architecture and scientific works;

i) Form No. 09: Declaration for registration of related rights.

Appendix 2 – Forms of Copyright Registration Certificates; Forms of Certificates of Registration of Related Rights:

a) Form No. 01: Certificate of Copyright Registration;

b) Form No. 02: Certificate of Registration of Related Rights.

The forms specified under the Circular are intended for use on A4 paper.

The Circular has taken effect from 15 July 2023. Circular No. 08/2016/TT-BVHTTDL dated July 2, 2016 of the Minister of Culture, Sports and Tourism providing for the forms in copyright and related rights registration activities has been annulled. If an application for registration of copyright or related rights had been submitted to a competent state agency before the effective date of the Circular, but a certificate of copyright registration or a certificate of related rights registration has not yet been issued, it may continue to be handled in accordance with the provisions of the legal documents in effect at the time of filing the application. All types of copyright registration certificates and related rights registration certificates had been issued before the effective date of the Circular shall continue to remain in effect.
