Latest Developments in Intellectual Property Law in Cambodia

Phnom Penh, Cambodia – Stay informed with the most recent updates on intellectual property (IP) rights, protection laws, and regulatory changes in Cambodia. This 2025 overview includes new legal developments in patent maintenance, trade secrets, enforcement mechanisms, and the promotion of geographical indications (GIs).

Whether you’re an innovator, rights holder, or investor, understanding Cambodia’s IP landscape is key to securing and managing your intellectual assets effectively.

1. IP Education & Public Awareness in Cambodia

In February 2025, Cambodia held an IP education seminar led by the Japan Patent Office (JPO) in partnership with JETRO, ERIA, and INPIT. Around 70 local officials attended, with sessions focused on:

  • Sharing Japan’s best practices in IP enforcement and awareness;
  • Discussing Cambodia’s roadmap to strengthen IP capacity building;
  • Improving public understanding of IP law and rights.

This initiative is part of a broader strategy to enhance intellectual property education in Cambodia.

2. Trade Secrets Law Under Development

As of mid-2025, Cambodia is in the process of drafting its first dedicated trade secrets law. On February 28, 2025, legal experts from S&O IP Cambodia and government representatives participated in a high-level forum in Phnom Penh. Key outcomes:

  • Frameworks for protecting confidential business information;
  • Legal expectations and best practices for compliance;
  • Final legislation anticipated before the end of 2025.

This signals Cambodia’s intent to align with global standards for trade secret protection.

3. Patent Law in Cambodia: Penalties for Late Annuity Payments

Effective October 15, 2024, Cambodia’s Ministry of Industry, Science, Technology & Innovation (MISTI) introduced new enforcement measures for patent holders:

  • 6-month grace period for missed annuity payments;
  • Daily fine of KHR 500 (~USD 0.125);
  • Restoration requires a USD 25 penalty fee, in addition to accrued fines.

Patent owners should now implement a compliance strategy to avoid costly lapses in rights.

4. IP Enforcement Infrastructure: Commercial Court & Capacity

Since its WTO accession in 2003, Cambodia has steadily advanced its IP legal framework, covering:

  • Trademarks;
  • Patents;
  • Copyrights;
  • Geographical indications;
  • Plant variety protection.

A dedicated IP court was projected to begin operations in 2024 to handle commercial disputes and rights violations. However, limited institutional capacity and a shortage of trained IP professionals continue to hinder full enforcement of the law.

5. IP Enforcement in Practice: A Reality Check

Despite formal IP laws, on-the-ground enforcement remains weak. Foreign trademark owners often report limited recourse unless they’ve registered locally.

A 2024 Reddit user summarized: “No shutdowns for infringement … you need trademark registration in Cambodia to do anything … authorities couldn’t care less.”

This highlights the ongoing gap between IP legislation and practical enforcement in Cambodia.

6. Promoting Geographical Indications (GIs)

Cambodia is actively promoting geographical indications (GIs) to protect and market local heritage products. Major GI registrations include:

  • Kampot pepper;
  • Kampong Speu palm sugar;
  • Mondulkiri wild honey.

These GIs are recognized under international systems like the Lisbon Agreement, helping boost rural economic development and global product branding.
