CIRCULAR

FORMS USED IN REGISTRATION OF COPYRIGHT, RELATED RIGHTS

Pursuant to the Law on Intellectual Property dated November 26, 2005; the Law on amendments to the Law on Intellectual Property dated June 19, 2009; the Law on amendments to the Law on Insurance Business, the Law on Intellectual Property dated June 14, 2019, and the Law on amendments to the Law on Intellectual Property dated June 16, 2022;

Pursuant to Decree No.17/2023/ND-CP dated April 26, 2023 of the Government elaborating the Law on Intellectual Property regarding copyright and related rights;

Pursuant to Decree No. 01/2023/ND-CP dated January 16, 2023 of the Government on functions, tasks, powers, and organizational structures of the Ministry of Culture, Sports and Tourism;

At request of the Director of the Copyright Protection Agency of Vietnam

The Minister of Culture, Sports and Tourism promulgates Circular on forms used in registration of copyright and related rights.

Article 1. Scope

This Circular prescribes registration forms for copyright registration, related right registration, and forms for certificate of registered copyright and certificate of registered related rights.

Article 2. Regulated entities

This Circular applies to all agencies, organizations, individuals engaging in copyright, related right registration.

Article 3. Forms attached hereto

Forms attached hereto include:

1. Appendix 1 – Copyright registration form; Related right registration form:
2. a) Form No.1: Copyright registration form for works of literature; science; lecture; speech, other talk; data collection; journalism; folk literature, folk arts, and other works depicted in form of handwriting or other symbols;
3. b) Form No. 2: Copyright registration form for works of applied arts;
4. c) Form No. 3: Copyright registration form for computer program;
5. d) Form No. 4: Copyright registration for works of music;
6. dd) Form No. 5: Copyright registration form for works of fine arts, works of photography;
7. e) Form No. 6: Copyright registration form for works of motion picture, works of theatrical arts;
8. g) Form No. 7: Copyright registration form for textbook, course book;
9. h) Form No. 8: Copyright registration form for works of architecture, flow chart, graph, map, drawing relating to geography, architecture, scientific works;
10. i) Form No. 9: Related right registration form.

Forms under this Article are designed for A4 paper format.

Article 4. Entry into force

1. This Circular comes into force from July 15, 2023.
2. Circular No. 08/2016/TT-BVHTTDL dated July 2, 2016 of the Minister of Culture, Sports and Tourism is annulled.

Article 5. Transition clause

1. If application for registration of copyright, related right is submitted to competent authority before the effective date hereof and certificate of registered copyright or certificate of registered related right has not been issued, the application shall be processed in accordance with legislative documents applicable at the time of submission.
2. All certificates of registered copyright, certificates of registered related rights issued before the effective date hereof shall remain effective.

Article 6. Responsibility for implementation

1. Agencies, organizations, and individuals engaging in copyright registration and related right registration are responsible for the implementation of this Circular.
2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Culture, Sports and Tourism (via Copyright Protection Agency of Vietnam)./.
